Rule 18
Use of Jurisdiction
: 1) Jurisdiction of Juvenile Court will be exercised collectively by judges, social workers, court psychologists or court experts.
(2) Notwithstanding anything written in sub-rule "(1), the judge shall not be hindered from hearing, taking action and dismissing the case even if social workers, child psychologists or child experts are not available in the juvenile court or are absent for any other reason.
(3) If there is no unanimity between the judge, social worker, child psychologist or child expert during the hearing of the case, the judge's decision on the legal question will be valid.
(4) If there is a situation where the punishment should be determined according to the Criminal Offenses (Determination and Execution of Punishment) Act, 2074, the judge will consider and determine the opinion of a social worker, child psychologist or child expert. (5) Social workers and child psychologists or child experts appointed for the child court shall not be allowed to participate in the hearing process of the case in which the child is a party and the case that cannot be heard according to the prevailing law.
